These terms apply to the free WordPress plugin “FormDoctor – Free Patient Intake Tools” (the “Plugin”), published by Stoic Technology LLC DBA FormDoctor (“FormDoctor”, “we”, “us”). They apply to anyone who installs, activates or uses the Plugin, and to the organization they act for (“you”).
The Plugin’s software is licensed under the GNU General Public License, version 2 or later (the “GPL”). Nothing in these terms limits the rights the GPL gives you to use, study, copy, modify or share the software. These terms explain what the Plugin is and isn’t designed for, what you’re responsible for, and the limits of FormDoctor’s responsibility. The GPL’s own disclaimer of warranty and limitation of liability (sections 11 and 12) also apply.
The Plugin is designed for public practice information (such as hours, locations, providers and self-pay prices) and general inquiries. It is not designed to meet the requirements of the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) or similar laws. In particular:
You must not use the Plugin to collect, transmit or store protected health information. This includes, for example, symptoms, diagnoses, medical history, medications, treatment details, insurance member or policy numbers, or any other health information linked to an identifiable person. Design your forms to ask only for general contact details, and tell visitors not to include medical information.
The Plugin’s patient tools (locations and hours, provider directory, insurance checker, new-patient guide, self-pay prices and visit checklist) run in the visitor’s browser and are designed not to send what visitors select or type to your website. You are responsible for how you configure and use them.
You are solely responsible for:
The Plugin runs on your website. FormDoctor does not receive, store or have access to form submissions or other information handled by the Plugin, except any information you choose to send us separately, such as a support request. FormDoctor is therefore not acting as your business associate when you use the Plugin, and no Business Associate Agreement applies to it.
FormDoctor’s paid services are offered under separate Terms of Service and, where applicable, a Business Associate Agreement. Those agreements, not these terms, govern the paid services.
You may choose to use the Plugin with services provided by others, such as your web host, email or SMTP provider, webhook destinations (for example Zapier, Make or a CRM) and mapping services linked from your pages. Those services are provided under their own terms and privacy policies. FormDoctor does not control them and is not responsible for them.
The Plugin is provided “as is” and “as available”, with all faults and without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, or that the Plugin will meet your requirements or any legal or regulatory requirement, including HIPAA. You use the Plugin at your own risk.
To the maximum extent permitted by law, FormDoctor and its owners, officers, employees, contractors and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, revenue, profits, goodwill or business, or for any fines, penalties, breach notification costs or regulatory actions, arising out of or relating to the Plugin or your use of it, however caused and under any theory of liability, even if advised of the possibility of such damages.
To the maximum extent permitted by law, FormDoctor’s total liability for all claims arising out of or relating to the Plugin will not exceed US $100.
Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you. In that case our liability is limited to the smallest amount permitted by law.
To the extent permitted by law, you agree to defend, indemnify and hold harmless FormDoctor and its owners, officers, employees, contractors and affiliates from any claims, damages, losses, fines, penalties and expenses (including reasonable attorneys’ fees) arising out of your use of the Plugin, including any collection, transmission or storage of protected health information through the Plugin, or your breach of these terms or of any law.
Information provided with the Plugin, including its documentation, settings screens and these terms, is general information only. It is not legal, compliance or medical advice. Consult your own qualified advisers about your obligations.
The Plugin may ask a site administrator to confirm that they have read and understood these terms, and may record which user confirmed, when, and which version of these terms they saw. By installing, activating or using the Plugin, or by confirming in the Plugin, you acknowledge that you have read and understood these terms and have authority to accept them for your organization.
We may update these terms from time to time. We will change the “Last updated” date above when we do, and the Plugin may ask administrators to confirm the updated terms. Your continued use of the Plugin after an update means you accept the updated terms.
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the Plugin will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these terms is not a waiver. These terms, together with the GPL, are the entire agreement between you and FormDoctor about the Plugin.
